Từ vựng:

estoppel by agreement

Giải nghĩa:

/ɪˈstɒpəl baɪ əˈɡriːmənt/ – Phrase

Definition: tước quyền phản đối vì các bên đã thỏa thuận với nhau.

A more thorough explanation: Estoppel by agreement is a legal doctrine that prevents a party from asserting a claim or defense that is inconsistent with a prior agreement or representation made by that party. This doctrine applies when a party has made a promise, representation, or agreement to another party, and the other party has reasonably relied on that promise, representation, or agreement to their detriment. The party making the promise or representation is then estopped, or prevented, from going back on their word and must adhere to the terms of the agreement.

Example: Suppose Party A and Party B agree that a certain piece of property belongs to Party A. Later, Party B cannot claim that they own the property if Party A has relied on their agreement, such as by making improvements to the property based on the belief that it is theirs.
